These Terms of Service (“Terms”) govern access to and use of the Kepa Solutions service, a SaaS platform that generates digital content using artificial intelligence (logos, banners, illustrations, business cards, UI kits, web content).
Three monthly subscription plans are offered:
Prices are quoted in euros (EUR). Any applicable sales tax or VAT is calculated and added by our payment processor (Stripe) at checkout based on the customer’s jurisdiction.
Your subscription renews automatically each month at the then-current price, until cancelled by you. By subscribing, you expressly authorize Kepa Solutions to charge your payment method, via Stripe, the recurring amount at each billing date without further notice. You may cancel at any time from your account; cancellation takes effect at the end of the current billing period, with no pro-rated refund.
All digital products are generated and delivered instantly upon payment confirmation, via direct download from your account. You expressly acknowledge that service performance begins as soon as your order is confirmed.
Payments are processed exclusively by Stripe, Inc., a PCI-DSS Level 1 certified provider. Accepted payment methods: Visa, Mastercard, American Express, Apple Pay, Google Pay. Kepa Solutions does not store or process your payment card data directly.
An electronic invoice is made available in your account for each charge.
All purchases and subscriptions are final and non-refundable. Because of the nature of the service (instant delivery of digital content that cannot be returned once downloaded), no refunds will be issued after payment confirmation, regardless of the reason. The only exceptions are manifest billing errors (duplicate charges, charges after effective cancellation), handled case-by-case by customer support.
You may cancel your subscription at any time from your account. Access to the service remains active until the end of the already-paid billing period, then automatically ceases. No partial refund is issued.
The Pro and Enterprise plans include a non-exclusive, worldwide commercial-use license for generated creations. The Basic plan is limited to personal, non-commercial use. You may not resell creations as such, nor use them to train a competing AI system.
You agree not to use the service to generate illegal, defamatory, hateful, or sexually explicit content involving minors, or content that infringes third-party rights. Any breach will result in immediate account suspension without refund.
The service is provided “AS IS” and “AS AVAILABLE”, without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by applicable law, Kepa Solutions’ total liability to you is limited to the amount you paid in the 12 months preceding the claim.
You agree to defend, indemnify, and hold harmless Kepa Solutions from any liability (including legal fees) arising from your use of the service or your breach of these Terms.
Kepa Solutions reserves the right to suspend or terminate your account in case of breach of these Terms, without notice or refund.
Kepa Solutions may modify these Terms. You will be notified by email at least 30 days before any change takes effect. Continued use of the service constitutes acceptance.
These Terms are governed by the laws of the State of Georgia, United States of America, without regard to conflict-of-law principles. Any dispute will be brought before the competent courts of the State of Georgia, USA. For consumers residing in the European Union, mandatory consumer-protection law of the consumer’s country of residence remains applicable where it provides greater protection.
